Skipper’s responsibilities
Fowey Classics are neither able nor qualified to inspect or assess boats or crews entered in this event for their suitability or otherwise to participate.

Fowey Classics take a very robust view about who is responsible for every aspect of boat management. The responsibility rests with the skipper of each boat entered. Every skipper is required to sign a liability disclaimer indicating that they accept this responsibility.

Every owner/skipper/competitor participating in Fowey Classics warrants the suitability of their yacht or boat for the afloat events in Fowey Classics.

The safety of a yacht or other boat and her entire management, afloat or ashore, shall be the sole responsibility of the owner/skipper/competitor who must ensure that the yacht or boat is fully found, thoroughly seaworthy, and manned by a crew sufficient in number and experience who are physically fit to face bad weather. The owner/skipper/competitor must be satisfied as to the soundness of their boat’s hull, spars, rigging, sails and gear and that safety equipment is properly maintained, stowed and in date and that the crew know where it is kept and how it is to be used. Nothing, whether in the Notice of Race or Sailing Instructions or anywhere else, reduces this responsibility. The provision of a Safety Boat, if any, does not diminish the responsibilities of the skipper.

The decision to participate in any of the afloat events and/or races organised by Fowey Classics rests entirely with the owner/skipper/competitor. It is for the participant to decide whether their boat and crew are fit to be afloat in the conditions in which they will or might find themselves.

Fowey Classics will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during or after this Rally, either afloat or ashore.
